Our fees cover all the work* required to complete the purchase of your new home, including dealing with registration at the Land Registry and dealing with the payment of Stamp Duty Land Tax (Stamp Duty) if the property is in England, or Land Transaction Tax (Land Tax) if the property you wish to buy is in Wales.

Disbursements are costs related to your matter that are payable to third parties, such as Land Registry fees. We handle the payment of the disbursements on your behalf to ensure a smoother process.

Stamp Duty or Land Tax (on purchase)

This depends on several factors including the purchase price of your property. You can calculate the amount you will need to pay by using HMRC’s website or if the property is located in Wales by using the Welsh Revenue Authority’s website.

For example, if you were not a first-time buyer and purchasing a freehold property for £500,000 as your sole property (either in the UK or abroad) the Stamp Duty Land Tax payable in England would be £10,000 (correct December 2018).

How long will my house purchase take?

How long it will take from your offer being accepted until you can move in to your house will depend on several factors. The average process takes between 6-8 weeks.

It can be quicker or slower, depending on the parties in the chain. For example, if you are a first-time buyer, purchasing a new build property with a mortgage in principle, it could take 4-6 weeks to exchange of contracts.  However, if you are buying a leasehold property that requires an extension of the lease, this can take significantly longer, between 3 and 4 months. In such a situation additional charges would apply.

How long will my house sale take?

How long it will take from you accepting an offer on your house until completion of the sale is largely dependent on your buyer and their circumstances.  The average process takes between 6-8 weeks.

It can be quicker or slower, depending on the parties in the chain. For example, if your buyer has already applied and been accepted for a mortgage.

How long will my re-mortgage take?

How long it will take to complete your re-mortgage is largely dependent on receipt of your mortgage offer.  The average process takes between 2-3 weeks from receipt of your mortgage offer.

Purchase of a leasehold residential property

Our fees cover all the work* required to complete the purchase of your new home, including dealing with registration at the Land Registry and dealing with the payment of Stamp Duty Land Tax (Stamp Duty) if the property is in England, or Land Transaction Tax (Land Tax) if the property is in Wales.

Disbursements

Disbursements are costs related to your matter that are payable to third parties, such as search fees. We handle the payment of the disbursements on your behalf to ensure a smoother process. There are certain disbursements which will be set out in the individual lease relating to the Property. The disbursements which we anticipate will apply are set out separately below. This list is not exhaustive and other disbursements may apply depending on the term of the lease. We will update you on the specific fees upon receipt and review of the lease from the seller’s solicitors.

The following is a list of anticipated disbursements*

Notice of Transfer fee – This fee if chargeable is set out in the lease. Often the fee is between £50-£100 plus VAT.

Notice of Charge fee (if the property is to be mortgaged) – This fee is set out in the lease. Often the fee is between £50-£100 plus VAT.

Deed of Covenant fee – This fee is provided by the management company for the property and can be difficult to estimate. Often it is between £100-£150 plus VAT.

Certificate of Compliance fee – To be confirmed upon receipt of the lease, as can range between £100-£150 plus VAT.

*These fees vary from property to property and can on occasion be significantly more than the ranges given above. We can give you an accurate figure once we have sight of your specific documents.

You should also be aware that ground rent and service charge are likely to apply throughout your ownership of the property. We will confirm the ground rent and the anticipated service charge as soon as this we receive this information.

Probate (Non-contested and UK only assets)

We can help you through this difficult process by obtaining the Grant of Probate on your behalf. We will also undertake the collecting and distributing of assets.

How much does this service cost?

If the total Net value of the estate is under the current Inheritance Tax limit our fees cover all the work* required to obtain the Grant of Probate as well as collection and distribution of assets.

Fixed Legal fees £1500 + VAT

VAT on legal fees £300.0

Disbursements: £381 in total (based on one executor and one beneficiary only)

Probate court fee of £160

Swearing of the oath £7 (per executor)

Bankruptcy-only Land Charges Department searches £4 (per beneficiary)

Post in The London Gazette (Protects against unexpected claims from unknown creditors) £180

Post in a Local Newspaper (This also helps to protect against unexpected claims) £30

If the total Net value of the estate exceeds the current Inheritance Tax limit an hourly rate of £300 per hour (plus VAT) will apply for legal fees. Disbursements will also apply as per the example above.

Disbursements

Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of the disbursements on your behalf to ensure a smoother process.

As part of our fixed fee we will:

Provide you with a dedicated and experienced probate solicitor to work on your matter

Identify the legally appointed executors or administrators and beneficiaries

Accurately identify the type of Probate application you will require

Obtain the relevant documents required to make the application

Complete the Probate Application and the relevant HMRC forms

Draft a legal oath for you to swear

Make the application to the Probate Court on your behalf

Obtain the Probate and securely send two copies to you

Collect and distribute all assets in the estate

On average, estates that fall within this range are dealt with within 3 months. Typically, obtaining the grant of probate takes 6 weeks. Collecting assets then follows, which can take a further 6 weeks. Once this has been done, we can distribute the assets, which normally takes 2 weeks.

* Our fees assume that:

this is a standard transaction and that no unforeseen matters arise including for example (but not limited to) a defect in title which requires remedying prior to completion or the preparation of additional documents ancillary to the main transaction

this is the assignment of an existing lease and is not the grant of a new lease

the transaction is concluded in a timely manner and no unforeseen complications arise

all parties to the transaction are co-operative and there is no unreasonable delay from third parties providing documentation

no indemnity policies are required. Additional disbursements may apply if indemnity policies are required.

In the unlikely event that your transaction does not meet the above assumptions, the following charges may apply for legal fees.  This would be discussed with you prior to commencement of any work.

PARTNERS: £300.00 per hour plus VAT

ASSISTANT SOLICITORS: £250.00 per hour plus VAT

LEGAL ASSISTANTS: £200.00 per hour plus VAT

All other Secretarial and Administrative staff: £150.00 plus VAT

Travelling expenses will be charged at cost for all rail or public transport.
